Introduction

These Terms and Conditions ("Terms") govern your use of Baby Sitters' Guild ("we," "us," "our") services, including our website, booking platform, and childcare services. By booking or using our services, you agree to these Terms. If you do not agree, you may not use our services.

These Terms constitute a legally binding agreement between you ("Client," "you") and Baby Sitters' Guild. By accessing our services, you represent and warrant that you have the authority to enter into this agreement on behalf of yourself and any children or dependents for whom you are booking services.

We reserve the right to decline or terminate services if the requested care falls outside the scope of our offerings or the designated geographic areas. Baby Sitters' Guild does not provide medical care, tutoring, or specialized therapeutic services unless specifically agreed upon in writing. Services are only available within the designated geographic areas listed on our website, subject to Care Provider availability.

Scope of Services

Baby Sitters' Guild provides professional babysitting and nanny placement services, offering personalized care tailored to families’ needs. Our services include temporary, long-term, and last-minute childcare arrangements.

We work diligently to match families with qualified Care Providers who meet their specific requirements; however, we do not guarantee compatibility or availability for every request. Clients are encouraged to communicate any concerns promptly to ensure service quality.

Booking and Payment Terms

Booking Process

  • Clients must provide as much detail as possible about their booking to ensure a seamless experience.

  • For children requiring special care, contact us directly at (212) 682-0227 before booking.

  • Failure to disclose accurate information regarding special care needs, allergies, or behavioral considerations may result in service termination without a refund.

  • All bookings are subject to Care Provider availability and are confirmed via an official email. Any requested changes must be approved in writing.

Payment Terms

  • Upfront Charges: Clients are charged upfront for the estimated hours, with a 4-hour minimum.

  • Final Charges: Adjustments are made to reflect the actual hours used.

Credit Card Authorization:

  • Your credit card will be collected at the time of booking to secure your appointment.

  • Cards are charged within 24 hours of service completion for estimated hours and any additional hours.

  • Cards may be charged within 48 hours for the mandatory 4-hour minimum, even if the service time is shorter.

  • Clients must ensure sufficient funds are available; declined payments may result in booking cancellations.

Additional Charges:

  • Services ending before 9 PM incur a caregiver transportation fee.

  • Services ending after 9 PM incur a caregiver transportation fee.

Booking Confirmation

  • Appointments and caregiver assignments are confirmed via email.

  • Clients must review confirmation details and notify us immediately of any changes or requests.

  • Baby Sitters' Guild reserves the right to reassign a Care Provider due to unforeseen circumstances, with prior notification to the client.

Cancellation Policy

  • Within 24 hours: Full booking fee applies.

  • Within 48 hours: A 4-hour minimum fee applies.

Emergency Situations and Medical Consent

In the event of a medical emergency:

  • Baby Sitters' Guild will make every reasonable effort to contact the parent/guardian.

  • If unreachable, we reserve the right to seek appropriate medical attention for the child(ren).

  • Care Providers are not authorized to administer medication unless explicitly agreed upon in advance.

For non-emergency situations requiring first aid (e.g., treating a scrape), Care Providers will notify the parent/guardian as soon as possible.

Promotional Codes and Discounts

  • Promo codes and discounts are non-transferable and subject to expiration dates.

  • Baby Sitters' Guild reserves the right to validate, deny, or revoke discounts in cases of misuse.

Confidentiality Agreement

  • All family information is treated as strictly confidential and used solely for providing childcare services.

  • Care Providers sign confidentiality agreements and are subject to disciplinary actions for breaches.

Dispute Resolution

Disputes will first be addressed through informal arbitration.

Governing Law

These Terms are governed by the laws of the State of New York. Disputes will be subject to the jurisdiction of the courts in New York County.

Pet Care

  • Light pet care (e.g., feeding, walking) may be provided upon request.

  • Clients must disclose and agree upon pet care services in advance.

  • Baby Sitters' Guild assumes no liability for incidents involving pets.

Data Security and Fraud Prevention

  • Payment data is encrypted and securely processed via Stripe.

  • Suspicious transactions may result in account suspension or cancellation.

Age of Use/Eligibility

  • You must be 18 years or older to use our services.

  • Proof of age or authorization may be requested at any time.

Force Majeure

Baby Sitters' Guild is not liable for delays or cancellations caused by events beyond our control, such as natural disasters or governmental restrictions.

Responsibilities of Baby Sitters' Guild

  • Provide fully vetted and trained Care Providers.

  • Investigate and address any service concerns reported within 24 hours.

Responsibilities of Parents/Guardians

  • Provide accurate details about the child(ren)’s care requirements.

  • Maintain a safe environment for caregiving services.

Non-Solicitation of Care Providers

  • Clients may not directly hire Care Providers without notifying Baby Sitters' Guild.

  • Violations are subject to a $10,000 placement fee.

SMS Consent and Communication

  • By providing your phone number, you consent to receive text messages for updates and reminders.

  • Standard message and data rates may apply.

Limitation of Liability

  • Baby Sitters' Guild shall not be held liable for injuries or damages caused by unsafe premises or undisclosed conditions.

  • Our total liability is limited to the fees paid for the specific service.

Intellectual Property

  • All content and materials are the exclusive property of Baby Sitters' Guild.

Changes to Terms

  • We reserve the right to modify these Terms at any time, with updates posted on our website.
